1. Acceptance of these terms

By accessing or using this website, you agree to these Terms of Service. If you do not agree, do not use the website. These terms apply to website use and preliminary enquiries. Additional written terms, quotations, invoices, production specifications, delivery terms or return conditions may apply to an order and will take priority where they expressly conflict.

2. Website purpose

The website presents MistpearlStudio collections, studio information, care guidance, bridal services and bespoke design options. Product descriptions, images, availability, prices and timelines are indicative unless confirmed in writing. Natural pearls vary in shape, colour, surface and lustre; these variations are part of their character and are not necessarily defects.

3. Enquiries and consultations

Submitting a form or email does not create an order or guarantee availability. A booking, custom project or purchase is confirmed only after the studio accepts the request and any required deposit or payment is received. Users are responsible for checking dates, measurements, spelling, metal choices, delivery details and design approvals before confirmation.

4. Eligibility and age

You must have legal capacity to enter an agreement. Users under 18 should involve a parent or guardian before requesting a paid service or placing an order. We may decline an enquiry where information is incomplete, abusive, unlawful, technically impracticable or outside available capacity.

5. Pricing and payments

Prices shown in New Zealand dollars are examples or starting points unless stated otherwise. Final pricing may depend on pearl selection, metal, size, labour, design complexity, shipping and taxes. Payment methods, deposit requirements and due dates will be confirmed before an order is accepted. We will not request payment card details through ordinary website enquiry forms.

6. Bespoke and personalised work

Custom work may require a non-refundable design or sourcing deposit once work begins, subject to New Zealand consumer law. Reasonable design revisions may be included as stated in a quotation. Changes after approval may affect price and timing. Because bespoke pieces are made to an approved specification, change-of-mind returns may be limited, but statutory rights for faulty or misdescribed goods are not excluded.

7. Delivery, collection and timing

Estimated production and delivery dates are provided in good faith but may change due to material availability, courier disruption, approval delays or events outside reasonable control. Risk and collection arrangements will be explained in order-specific terms. Customers must provide a safe, complete delivery address and promptly report visible transit damage or missing parcels.

8. Consumer rights

Nothing in these terms excludes rights that cannot lawfully be excluded under New Zealand law, including applicable rights under the Consumer Guarantees Act 1993 and protections against misleading conduct under the Fair Trading Act 1986. Where those laws apply, they prevail over inconsistent contractual wording.

9. Intellectual property

Website text, original photography, branding, graphics, layouts and jewellery designs are owned by or licensed to MistpearlStudio. You may view and print reasonable extracts for personal, non-commercial use. You may not copy, sell, scrape, republish, manufacture from, or create confusingly similar branding or designs without written permission.

10. Prohibited conduct

You must not attempt to damage the website, bypass security, submit malicious code, impersonate another person, misuse forms, harvest data, infringe rights, make unlawful claims, or use content for deceptive or unauthorised commercial activity. Automated access that places an unreasonable load on the site is prohibited.

11. External links and availability

External links are provided for convenience and do not imply endorsement. We do not control third-party websites or their privacy and security practices. The website may be changed, suspended or unavailable for maintenance, security or operational reasons without guaranteeing uninterrupted access.

12. Disclaimers and liability

We take reasonable care with website content but do not guarantee that every page is error-free or current. To the maximum extent permitted by law, MistpearlStudio is not liable for indirect, incidental or consequential loss arising solely from use of this informational website. This limitation does not apply where liability cannot legally be limited.

13. Suspension and termination

We may restrict access or stop responding to misuse, threats, fraud attempts, repeated abusive conduct or legal risk. Provisions concerning intellectual property, liability, governing law and accrued rights continue after access ends.

14. Governing law and changes

These terms are governed by the laws of New Zealand, and disputes are subject to the jurisdiction of New Zealand courts unless mandatory consumer rules provide otherwise. We may update the terms as the website or services change. Continued use after publication of updated terms means the new version applies to later website use.
